Rasilio Terms and Conditions of Use

1. Introduction and Acceptance of Terms

Welcome to Rasilio. These Terms and Conditions (the “Agreement”) govern your access to and use of the Rasilio web platform, AI agent tools, and WhatsApp marketing automation infrastructure (collectively, the “Service”).

By registering an account, accessing, or using the Service, you agree to be bound by this Agreement, the WhatsApp Terms of Service, and all applicable laws. If you do not agree to these terms, you must immediately cease using the Service.

2. Nature of the Service

Rasilio provides an automation and AI orchestration platform utilizing secure linked-device protocols to facilitate communication with your customers on WhatsApp. You acknowledge that you are solely responsible for all content, campaigns, and data you transmit or receive through the Service.

3. Prohibited Uses (Grounds for Immediate Account Ban)

The Service is intended solely for lawful, legitimate business purposes. In addition to general compliance with applicable laws, you strictly may not use the Service to promote, distribute, or facilitate any of the following:

  • Intellectual Property Violations: Distributing content that infringes upon copyrights, trademarks, or other IP rights. This explicitly includes promoting, hosting, or facilitating IPTV services or pirated content.
  • Violations of Islamic Principles: Distributing or promoting content or activities that go beyond the permissible boundaries of Islamic law. This includes, but is not limited to, content deemed immoral or haram.
  • Gambling and Betting: Promoting, operating, or dealing with gambling, betting websites, or similar activities.
  • Financial Products Involving Interest (Riba): Promoting or selling financial products or services that involve interest (riba), including but not limited to certificates of deposit, bonds, traditional bank loans, credit cards, treasury bills, or installment plans carrying interest.
  • Digital Subscriptions: Selling or promoting unauthorized or third-party subscriptions to video streaming platforms (e.g., Shahid, Netflix, Amazon Prime, Disney+) or music platforms (e.g., YouTube Music, Anghami, Spotify).
  • Restricted Physical Goods: Selling or promoting smoking-related products (including e-cigarettes, vaping devices, coils, and derivatives), alcohol, or illegal substances.
  • Sexual Content: Selling, promoting, or distributing sexual services, adult content, or related products of any kind.
  • Spam and Abuse: Engaging in abusive messaging practices that maliciously violate WhatsApp’s anti-spam policies.

Enforcement: Use of the platform that conflicts with these restrictions is strictly prohibited. Rasilio reserves the right to actively monitor compliance and will enact immediate, permanent suspension or termination of your account without notice or refund if a violation occurs.

4. WhatsApp Terms of Service Compliance

By using Rasilio, you acknowledge and agree to comply with the official WhatsApp Terms of Service (https://www.whatsapp.com/legal/#terms-of-service). While Rasilio provides intelligent pacing and message rotation to protect your sender reputation, you understand that violating Meta/WhatsApp’s core policies may still result in your WhatsApp number being blocked or banned by Meta. Rasilio holds no liability for actions taken by Meta against your specific WhatsApp account.

5. Content Ownership and Privacy

Rasilio operates on a “Zero-Data Retention” architecture regarding your active messaging traffic. We process data to facilitate delivery; we do not store it. However, you grant Rasilio a worldwide, non-exclusive license to temporarily process the content you transmit solely for the purpose of executing the Service and generating AI responses.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. RASILIO EXPLICITLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Rasilio does not warrant that the Service will be uninterrupted, error-free, or 100% immune to Meta/WhatsApp algorithm updates. Furthermore, Rasilio makes no absolute guarantees regarding the delivery rate of messages or immunity from WhatsApp account bans, as final delivery control remains with Meta’s infrastructure.

7. Limitation of Liability

IN NO EVENT SHALL RASILIO, ITS FOUNDERS, AFFILIATES, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. This includes, without limitation, loss of profits, loss of data, loss of a WhatsApp number, or interruption of business, even if Rasilio has been advised of the possibility of such damages.

Rasilio’s total maximum liability to you arising out of or in connection with this Agreement shall not exceed the total subscription amount paid by you for the Service during the one (1) month immediately preceding the event giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Rasilio and its affiliates from any claims, damages, losses, or liabilities (including legal fees) arising out of your use of the Service, your violation of this Agreement, or any content you transmit that violates third-party rights or applicable laws.

9. Modification and Termination of Service

Rasilio reserves the right to modify, suspend, or terminate the Service (or any part thereof) at any time, with or without notice. We also reserve the right to update this Agreement periodically. Continued use of the platform following the posting of an updated Agreement constitutes your acceptance of the new terms.

10. General Provisions

  • Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the Sultanate of Oman [or your specific operating jurisdiction], without regard to its conflict of law provisions. Any dispute shall be resolved exclusively by the competent courts of this jurisdiction.
  • Assignment: You may not assign or transfer your account or this Agreement without prior written consent from Rasilio. Rasilio may assign this Agreement freely.
  • Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: The failure of Rasilio to enforce any right or provision of this Agreement shall not be deemed a waiver of such right.
  • Entire Agreement: This Agreement, alongside the Privacy Policy, constitutes the entire agreement between you and Rasilio.
